Question Number  1:   When attempting to download the required Submittal 2 and Exhibit E spreadsheets from the directions and links provided, it gave an error and said that the ‘file or directory not found’. Will these be re-posted, or sent out soon?

Question Number  2:   Does a win on this RFP mean we are excluded from participating in other A/E “full design” On-Call RFPs?
    Answer:   The selected proposer for this RFP will not be excluded from participating in other A/E "full design" On-Call RFPs.
Question Number  3:   It appears that the request is for full service consulting teams, but on Attachment 5 – Scope of Work it states that “The Consultant core team must consist of architect(s), engineer(s), interior designer(s), facility planner(s), and strategic planner(s)…”   There is no mention of landscape architects.  Should landscape architect(s) be included on proposing teams?
    Answer:   The Consultant core team as defined in Attachment 5 - Scope of Work only identified the minimum team structure. It is at proposer's discretion to form the proposal team as long as the minimum requirements are met.
Question Number  4:   If we have a contractor on our team to provide cost estimating services for the new on-call, does that preclude them from pursuing the actual execution of the work if it becomes an actual project?
    Answer:   A contractor in the team providing cost estimating services for this on-call services may not preclude them from pursuing the actual execution of the work if it becomes an actual project. With this being said, the City reserves the right to evaluate and determine whether a conflict exists at the time the Work is awarded.
Question Number  5:   If a contractor was to provide cost estimating services as a part of our team for this on-call, would that preclude that contractor from pursuing any work that may result?
    Answer:   See response to question #4.
Question Number  6:   Has an overall dollar value been established for this contract?
    Answer:   No dollar value has been established and contract valve will be dependent on the pool of qualified proposals.
Question Number  7:   Is the page limit intended as 40 sides (20 pages front-and-back) or is it 80 sides (40 pages front-and-back)? We assume 40 sides, but please confirm.
    Answer:   The page count shall not exceed 40 pages total (20 pages front-and-back). This page limit does not include resumes, cover letter, disclosure of legal and administrative proceedings and financial condition, tabs and City required forms.
Question Number  8:   Referencing the “Page 37” of the RFP PDF file… I am a little unclear on this statement: “Insert the scanned copy of the Diversity and Inclusiveness in City Solicitations Form immediately following this page.” Does this mean that you would like us to actually include Page 37 in our proposal, followed by the scanned copy of the DICS Form following it? Or do we only need to include the scanned DICS Form?
    Answer:   Please include Page 37 of the RFP in your proposal, followed by the scanned copy of the Diversity and Inclusiveness in City Solicitations Form, following it?
Question Number  9:   On “Page 20” of the RFP PDF file, it states that we must include a “Commitment to MBE/WBE Participation” page in our proposal, and that it must “address and confirm the following understandings” found in points 9a, 9b, 9c and 9d. Does completion of the “Commitment to MWBE Participation” Form on (Page 46 of 100) of the RFP PDF file satisfy the requirement of addressing points 9.a-d? It appears that Form does not fully address points 9.a-d. So do we need to also include a separate letter that specifically states that we: a. understand we must maintain the designated MBE/WBE goal or good faith commitments throughout the life of the Agreement, in accordance with the requirements set out in D.R.M.C. 28-72. b. understand we must establish and maintain records and submit regular reports, as required, which will allow the City to assess progress in satisfying the MBE/WBE participation goal. c. understand that if amendments or any other agreement modifications are issued under the Agreement, we shall have a continuing obligation to immediately inform DSBO, in writing, of any agreed upon increase or decrease in the scope of work of such Agreement, regardless of whether such increase or decrease in scope of work has been reduced to writing at the time of notification. d. understand that if amendments or other Agreement modifications are issued under the Agreement and such changes result in an increase in scope of services in an Agreement or otherwise increase the dollar value of the Agreement, whether or not such change is within the scope of work designated for performance by a MBE or WBE at the time of contract award, such changes shall be contemporaneously submitted to DSBO... etc. etc.?
    Answer:   On pg. 20 of the RFP #9 - Commitment to MWBE Participation Form, please see below responses to A through D. (a.) If the bidder is committed to the minimum goal, you are agreeing to items 9, a-d. A-D are agreements that you will follow and you are confirming to commit to the goal and compliance. No additional letter is required for A-D. (b.) If the bidder is unable to meet the minimum project goal, then the Modified Effort Guidelines must be met. The GFE will have to be approved by DSBO. You are still committing to 9, a-d. No additional letter is required for A-D. (c.) In both instances, you are agreeing to 9, a-d. They are just spelled out, so you know what will be required through the life of the contract. (d.) The Good Faith Effort will be used when you are unable to meet the minimum project goal. This is separate process that requires specific questions to be answered, Sec. 28.128. Procurement goals-Good Faith Efforts
Question Number  10:   On “Page 21” of the RFP, under 1-9 Designation of Subconsultants, it says we must “describe the qualifications of each subconsultant we intend to use and the percentage and scope of the work which will be assigned to each of them.” Is there an official form we should fill out to describe the subconsultants’ qualifications and the percentage and scope of work? I don’t see one that appears to directly address this, so I’m unsure how to do this. I’m also unsure where to include this in our proposal: Should it go in Section 10 “Additional Information”? Or Section 11 “Required Forms”?

Question Number  11:   Also on “Page 21” of the RFP, under 1-9 Designation of Subconsultants, it says we must include resumes for the subconsultants’ key personnel. Where should these appear in our proposal? In Section 10 “Additional Information”? Or Section 11 “Required Forms”?
    Answer:   On “Page 21” of the RFP, under 1-9 Designation of Subconsultants, this is just information. Please note the resumes for the subconsultants’ key personnel must be included under section 1-6 Proposal Narrative Contents No.5 Personnel.
Question Number  12:   Will the City be updating the indemnification obligations in the Agreement to comply with Colorado’s prevailing law?
    Answer:   The final executed agreement will contain the City's approved indemnification provision for design contracts.
Question Number  13:   Does DEN have a schedule for selection of “Qualified/Responsive Proposers” to participate in interviews?
    Answer:   No, the schedule is TBD at this time.
Question Number  14:   May we use smaller than 12pt font on graphics/tables/organizational charts?
    Answer:   Yes, per Section 1-6 B. Format, if proposals contain tables or graphics the font must be legible.
Question Number  15:   Are captions for photos permitted on page dividers without counting against our page count?
    Answer:   Tabs do not count towards the 40 page count, tabbed or bookmarked sections are able to have photos on them.
