NOTICE OF INVITATION FOR PROPOSALS
Denver, Colorado January 12, 2009
Sealed proposals for Contract No. CE 73062, CE 93011, SMALL BUSINESS DEFINED POOL ON-CALL CONSTRUCTION SERVICES 2009-7, 2009-7A, will be received no later than 2:00 P.M., Local Time, February 4, 2009 and delivered to Nathan Jones, Room 8810, Airport Office Building (AOB), Denver International Airport, 8500 Peña Blvd., Denver, CO 80249-6340. Proposals shall be submitted in the form for two CDs.
There will be two (2) Small Business Defined Pool Defined Pool On-Call Construction Services contracts awarded from this procurement. To be considered for both contracts, Proposers need only to submit ONE proposal since both contracts are identical in size and scope.
Prior to submitting a proposal, the proposer shall consult the Contractor's bulletin board located at Denver International Airport, 8500 Peña Boulevard, Denver, Colorado 80249, on wall south of the entrance to the Airport Office Building (AOB) on the bridge to Concourse A. The AOB entrance and the Contractor’s bulletin board are located west of, and outside, the Concourse A security screening area.
GENERAL STATEMENT OF WORK
The project consists of two SMALL BUSINESS DEFINED POOL ON-CALL CONSTRUCTION SERVICES contracts – work will consist of a wide range of construction projects at Denver International Airport. Tasks will be incorporated into the contract through task orders. Each contracts performance time will consist of a two (2) year period, or until the maximum contract amount of $3,000,000.00 is reached, whichever occurs first.
ESTIMATED COST
Cost of work for this contract is estimated to be between $1 and $3,000,000.00. The maximum task order amount for this contract will be $500,000.00 either in initial cost or final adjusted task order amount as determined by the Manager of Aviation or designated representative.
DOCUMENTS AVAILABLE
Contract documents, including specifications, in the form of CDs, will be available for purchase at the Technical Services Office, Department of Aviation, Room 8810 Airport Office Building, 8500 Peña Boulevard, Denver, Colorado 80249, at a cost of $50.00 per set (no refund) beginning January 14, 2009. Make checks payable to Airport Revenue Fund. Upon request, Proposers who have previously submitted proposals for Small Business Defined Pool On-Call Construction contracts and those contracts have been canceled; those proposers will not be charged the $50.00 document cost.
PREQUALIFICATION
Each proposer must hold a City and County of Denver Building Contractor Class B license.
PRE-PROPOSAL CONFERENCE AND INSPECTION
There will be no Pre-Proposal Conference for these projects.
DEFINED POOL SELECTION REQUIREMENTS
This construction contract solicitation is subject to the defined pool selection requirements of Article VII, Chapter 28 of the Denver Revised Municipal Code (D.R.M.C.) (the “SBE Ordinance”) and, as such, this contract is excluded from the coverage of Article III, Chapter 28 of the D.R.M.C.
Section 28-207, D.R.M.C. of Article VII authorizes the Director of the Division of Small Business Opportunity (DSBO) to designate selected design and construction service contracts to be restricted for award only to Small Business Enterprises (SBEs) participating in the defined pool selection program. The Director has designated this project solicitation and, under the program, award will be strictly limited to currently certified SBE proposers/joint venturers who comply with the requirements of Article VII. Proper SBE certification in accordance Section 28-206, D.R.M.C. shall be a condition of responsiveness and award will only be made to an SBE Proposer. Under Section 28-208, D.R.M.C., compliance with this defined pool selection requirement shall be mandatory for all proposers and shall require a demonstration that each proposer is either: (1) a certified SBE contractor or (2) a qualified joint venture that includes a certified SBE contractor. In addition, each proposer must establish that such SBE will perform a commercially useful function.
Section 28-209, D.R.M.C., directs the Director of the Division of Small Business Opportunity to establish a mandatory SBE subcontractor participation requirement for selected projects. The mandatory SBE subcontractor participation requirement for this project is:

Each proposer shall submit, by the deadline for submitting proposals, the completed forms and other information required by DSBO to demonstrate compliance with the requirements of Article VII under Section 29-212, D.R.M.C. A determination by DSBO that a proposer has failed to comply with the defined pool selection requirement specified herein and set forth in Chapter VII and, as such, is non-responsive shall result in no further consideration of the proposal by the Manager of Aviation.
NON DISCRIMINATION IN THE AWARD OF CITY CONTRACTS
It is the policy of the City and County of Denver to prohibit discrimination in the award of Construction contracts and subcontracts for public improvements. Further, the City and County of Denver encourages contractors to utilize SMALL owned businesses and to divide the construction work into economically feasible units or segments to allow the most opportunity for subcontracting.
MISCELLANEOUS
As its best interests may appear, the City and County of Denver reserves the right to reject any or all proposals and to waive informalities in proposals.
The work under the Contract is subject to minimum wage rates established by the City and County of Denver Career Service Board.
All contracts made and entered into by the City and County of Denver are subject to Affirmative Action and Equal Employment Opportunity Rules and Regulations as may be adopted by the City and County of Denver.
