The ACDBE Program is a federal program applicable to airports that receive federal funds through grants from the FAA.
ACDBE certification affords small businesses the opportunity to compete for concessions contracts, either as an operator or supplier, at Denver International Airport (DEN), as well as other airports receiving federal funding throughout Colorado. It is race and gender conscious.
What rules determine social and economic disadvantage?
- Presumption of disadvantage: 49 CFR 26.67(a):
Owners of a firm applying to participate as a ACDBE, whose ownership and control are relied upon for ACDBE certification, must be citizens of the United States (or lawfully admitted permanent residents) who are women, Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans, Subcontinent Asian Americans, or other minorities found to be disadvantaged by the SBA, are socially and economically disadvantaged individuals.
- Ownership: 49 CFR 26.69(b):
To be an eligible ACDBE, a firm must be at least 51 percent owned by socially and economically disadvantaged individuals.
- Personal Net Worth: 49 CFR 26.67(a)(2)(i), 49 CFR 23.33(a)
Each individual owner of a firm applying to participate as a ACDBE, whose ownership and control are relied upon for ACDBE certification, must certify that he or she has a personal net worth that does not exceed $1.32 million.
- Gross Receipts: 49 CFR 23.33(a):
A small business may be eligible to be certified as an ACDBE if its gross receipts, averaged over the firm's previous three fiscal years, do not exceed $56.42 million.
49 CFR 23.33(b)(1)(2)(3)(4) The following types of businesses have size standards that differ from the standard:
- Banks and financial institutions
- Car rental companies
- Pay telephones
- Automobile dealers
- Control:
49 CFR 26.71(g) Socially and economically disadvantaged owners must have an overall understanding of, and managerial and technical competence and experience directly related to, the type of business in which the firm is engaged and the firm's operations.
49 CFR 23.37(b) Disadvantaged owners must be able to control the firm with respect to its activity in the concessions program. In addition, as a part of 49 CFR 23 an ACDBE firm must do work relevant to the airport's concessions program.
A Joint venture is an “association of an ACDBE firm and one or more other firms to carry out a single, for-profit business enterprise, for which the parties combine their property, capital, efforts, skills and knowledge, and in which the ACDBE is responsible for a distinct, clearly defined portion of the work of the contract and whose shares in the capital contribution, control, management, risks and profits of the joint venture are commensurate with its ownership interest.”

(It's important to note that other City and County of Denver local certifications are processed separately by the city's Division of Small Business Opportunity (DSBO) and therefore must be submitted separately from ACDBE certifications.)
Fee: There is no application fee or administrative charge.
Annual No Change Affidavit: 49 CFR 26.83(j)
Each year your firm is required to provide an affidavit indicating that there have been no changes in the firm’s circumstances affecting its ability to meet size, disadvantaged status, ownership, or control requirements.
